Missed Your NYC Parapet Inspection? Fines, Violations and How to Fix It
If you missed your annual parapet inspection in NYC, you're out of compliance with Local Law 126, and the DOB can issue a violation the moment it asks for a report you don't have. The good news: you can get back into compliance quickly by booking an inspection now.
Here's what a missed parapet inspection can cost you, and how to fix it before December 31, 2026.
Parapet Inspection Fines and DOB Violations
Parapet reports aren't filed with the DOB, so there's no automatic penalty on January 1. The risk comes when the DOB asks to see your reports, often during a complaint, a 311 call or another inspection.
•No report on request = a violation. The DOB's own construction advisory states that failing to present the report will result in one.
•The fine: industry sources put it at a minimum of $1,250 per violation, up to $10,000.
•Each year counts. Owners must keep six years of reports, so every missing year is a gap the DOB can find.
The Bigger Risk Isn't the Fine
An uninspected parapet can hide cracks, loose bricks or failing coping stones until something falls. Parapet failures have killed people in NYC, including Erica Tishman and Greta Greene.
If debris injures someone and you have no report on file, that gap can be used against you in a liability claim. Emergency repairs and sidewalk sheds also cost far more than a routine inspection.
How to Fix a Missed Parapet Inspection
1.Book an inspection now. Any competent inspector can do it under 1 RCNY §103-15, but an experienced firm gives you a report that holds up.
2.Get a complete report. It needs dated photos, the parapet's construction details, conditions found and repairs made.
3.Repair anything unsafe. Unsafe conditions must be reported to the DOB and fixed within 90 days.
4.Don't backdate missing years. Keep the new report dated honestly and stay on schedule from here.
5.If you've already been cited, respond to the violation by its deadline. DOB violations are heard at OATH, where showing a current report can help your case.
6.Set a yearly reminder. Book next year's inspection as soon as this one is done.
